Online/Live YOUNG CHAMPIONS AUCTION : terms of sale and auction

 

1. The online / live auction is organised by YOUNG CHAMPIONS AUCTION BV with registered offices at 2280 GROBBENDONK, Troon 22, CBE number 0787292283, referred to hereafter as YOUNG CHAMPIONS AUCTION

 

2.These terms of sale and auction, referred to hereafter as “Terms”, apply to any use of the auction website of YOUNG CHAMPIONS AUCTION BV and to any auction organised by YOUNG CHAMPIONS AUCTION BV

 

3. In order to take part in an auction, both the Seller and the Buyer/Bidder have to register in advance at www.youngchampions.auction  By signing the registration form, the Seller and Buyer/Bidder declare to take note of the Terms, to understand them, to accept them and to be in the possession of a copy.

 

4. Together with the purchase agreement, the Terms are a part of the overall agreement between the Seller and the Buyer, referred to hereafter as the “Agreement”. The Agreement represents the consent of the parties fully and exclusively, with the explicit exclusion of all other verbal and/or written agreements, communication, offers, proposals or correspondence between the parties.

 

5. YOUNG CHAMPIONS AUCTION BV only offers the parties auction services and will never at any time become a party to the Agreement, nor will he/she ever act on behalf and/or for the account of the Seller or the Buyer/Bidder, unless YOUNG CHAMPIONS AUCTION BV sells its own horses at the auction.

 

 

6.The Seller agrees to deliver professional photos and videos to YOUNG CHAMPIONS AUCTION BV  minimum 8 weeks prior to the auction in question. The description of a ‘lot’ put up for sale, referred to hereafter as the “Lot”, will be based on the description given by the Seller and will consequently be on a ‘best knowledge’ basis, where YOUNG CHAMPIONS AUCTION BV has no knowledge of his own of the Lot, nor of any existing rights of third parties, charges or seizure of goods on the property.

 

7. Each Lot will be auctioned in its current state at the moment of the auction.  Prior to the auction the horses have undergone a vet check with X rays.

 

8. Each offer is deemed to have been made in the parties own name and for his own account. By submitting a bid, the Buyer/Bidder commits himself to paying the amount of the bid he offered, referred to hereafter as the “Allotment Price”, except in case of a subsequent higher bid. Each bid and each payment can only be done in Euros.

 

9. At his/her website, YOUNG CHAMPIONS AUCTION BV mentions for each auction of a Lot an indicative closing time. This closing time will automatically be extended by five minutes if, within the last five minutes of the auction, a higher bid was submitted for the Lot. At that time, a new closing time will be determined.

 

10.The Seller and the Buyer/Bidder know, acknowledge and accept the special circumstances that can happen during an online auction, and the technical shortcomings that can come with it, for which YOUNG CHAMPIONS AUCTION BV gives no guarantee or takes any responsibility/liability.

 

11.At the closing time, each Lot will be allocated to the submitter of the highest bid, referred to hereafter as the “Buyer”, for the amount of the Allotment Price which is owed immediately.  In case of non payment by “Buyer” the latest seven days after the allotment, “Buyer” is due a rent of 5% daily on the allotment amount. The seller has in this case also the right to resolve the sale with the obligation for buyer to pay an amount of 50% of the allotment price as an indemnification, or seller has the right to pursue the closure of the sale in which case buyer is obliged to pay a fixed amount as indemnification of 20% on the allotment price extra on top of the allotment price.

 

12.The Buyer will receive a payment invitation from YOUNG CHAMPIONS AUCTION BV for the payment of the net price, composed of the Allotment Price increased with 10% auction fee and increased with the applicable VAT rate.

 

13.The Seller is owed a commission fee of 10% of the Allotment Price to YOUNG CHAMPIONS AUCTION BV in case of the sale to a third person or in case the Seller repurchases the Lot for a price higher than the minimum price set between seller and YOUNG CHAMPIONS AUCTION BV .  In case the Seller repurchases the Lot from the Buyer at a repurchase price lower or equal to the set minimum price, the Seller does not owe a commission fee to YOUNG CHAMPIONS AUCTION BV as defined also in article 16 of these auction terms and conditions.

 

14.As soon as YOUNG CHAMPIONS AUCTION BV  has received the complete payment from the Buyer, he/she will transfer the amount the Seller is entitled to, as described above, to the Seller.

 

15.If the Seller is subject to VAT, he agrees to deliver an invoice to the Buyer within seven days after total payment as mentioned in article 12 of these terms and conditions.

 

16.In case the Seller repurchases the Lot from the Buyer at a repurchase price lower or equal to the amount of the minimum price, the Seller does not owe a commission fee to YOUNG CHAMPIONS AUCTION BV .  In case the Seller repurchases the Lot for a price higher than the minimum price, he is owed a commission fee of 10% of the repurchase price.   The minimum price will be defined between seller and YOUNG CHAMPIONS AUCTION BV prior to the auction.

 

17.The ownership of the Lot transfers to the Buyer on the moment of complete payment to YOUNG CHAMPIONS AUCTION.

 

18. Buyer has no right to withdraw the sale.  Concerning particular buyers/consumers, the exception of article VI, 53, 11° WER is applicable.  If there anyway would be the right to withdraw, there is a delay of fourteen days after the allotment as mentioned of article 11 of these terms and conditions to exercise this right to withdraw.  After this delay the sale will be anyway definite and no subject to any right of buyer to withdraw anymore.

 

19. Collection of the Lot by the Buyer from the Seller is possible after receiving the complete payment from both the Seller and Buyer. The modalities of the collection will be stipulated between the parties, but any costs of transportation or delivery will be charged to the Buyer.

 

20. The surrogate mare that is on loan to the buyer for bearing an embryo remains the property of the seller and after prior notification, no later than 6 months after the birth of the foal, is returned by the buyer to the seller, in good health, dewormed and vaccinated.  If the seller prefers, he may require a deposit/warranty from the buyer for the loan of the carrier mare, the price of the deposit/warranty will be informed specific in the information sheet from each Lot/embryo. The deposit/warranty is refunded to the buyer when the receptor mare is returned in good condition, as mentioned above.  The seller bears full responsibility for the surrogate mare and its unborn foal after the date of sale. If the surrogate mare dies, the buyer will inform the seller straight away and will deliver a veterinary report of death to the buyer. If it is informed on the information sheet at the Lot/embryo, the buyer will name the foal after the stud of the seller.

 

 

21.In case of export the buyer, the buyer shall present a valid export document within 3 months after the auction or be liable for VAT.

 

22.Bidding info:

Sporthorses start with  20.000 Euro

Young horses start with  10.000 Euro

       Embryo’s start with 5.000 Euro

        Per 100 Euros to 5.000 Euro

        Per 500 Euros  from 5.000 Euro to 10.000 Euro

        Per 1.000 Euros from 10.000 Euro to 20.000 Euro

        Per 2.000 Euros from 20.000 Euro to 50.000 Euro

        Per 5.000 Euros from  50.000 Euro to 100.000 Euro

        Per 10.000 Euros from 100.000 Euro

 

 

23.The liability of YOUNG CHAMPIONS AUCTION BV towards the Seller, Buyer and Bidder is limited to what is stipulated in the Terms and is in any case limited to the value of the Lot in question.

 

 

24.YOUNG CHAMPIONS AUCTION BV  cannot be held liable for any printing or typing errors on the website and/or online catalogue.

 

25.YOUNG CHAMPIONS AUCTION BV neither guarantees the correctness of the identity of the Buyer/Bidder. He/she is not responsible for finding out the correct identity or for the possible non-payment by the Buyer.

 

26.Each dispute or discussion between the Seller and the Buyer has to be solved exclusively between them.  YOUNG CHAMPIONS AUCTION BV  can’t and won’t intervene in the discussion.

 

27.To all legal relationships between the Buyer/Bidder and/or the Seller and/or YOUNG CHAMPIONS AUCTION BV  Belgian law is applicable exclusively, with the explicit exclusion of the Vienna Sales Convention.

 

28.For each dispute that rises, is connected to or arises from the legal relationships between the Buyer/Bidder and/or the Seller and/or YOUNG CHAMPIONS AUCTION BV, the courts of ANTWERP,  Belgium are competent.

 

29.The Dutch version of these Terms will prevail over any other versions, no matter who wrote them.

 

30.Each stipulation of the Terms that would be invalid, void or unenforceable, due to incompatibility with a legal provision of compulsory law or law of public order, will nevertheless fall within its maximally allowed effect and will leave the application of the rest of the terms unaffected.
